First, buying/selling links <em>isn't</em> illegal unless it's done under fraudulent terms (<em>in order for something to be illegal, it needs to be against the law</em>), however, Google does frown upon it. Whether your site gets banned or not depends greatly on the value of your site to begin with. If you have a splog or crappy website, you can bet your bottom dollar that your site will probably be dropped.
